Like I said, they probably have a Zero-Tolerance policy (writing on the desk can be described as vandalism), thus relieving them of the need to think and make logical judgements. Congrats, this line proves you didn't actually bother to read our posts. We both agree it was retarded that they arrested her. But from a legal standpoint, they were right. Meaning we both agree, yes, she shouldn't have been arrested.

However, the school was well within their legal right to call the police, even if that isn't what common sense would dictate. But common sense unfortunately, doesn't, and in many situations, shouldn't dictate how things are done.

I'm afraid I refuse to believe that children drawing on desks is illegal because it means 90% of all people are criminals, including me.

Frankly, the officer concerned should have arrested them for wasting police time. I don't know how it works in the US, but in the UK, I would imagine such a case would have been thrown out on the grounds that it was not in the public interest to prosecute.

As explained it is, just as drawing on a wall is illegal. It's just that most people are sensible enough to not make a criminal case out of it.
